In the bustling city of Ikeja, where the real estate market is thriving, tenants and landlords often find themselves entangled in legal disputes.
A recent case sheds light on the challenges faced by a tenant seeking the refund of her caution fee and the subsequent legal battle that ensued.
To provide valuable insights, an interview was conducted with a seasoned lawyer handling the case, offering practical solutions for both landlords and tenants in Ikeja. He emphasized the importance of upholding contractual agreements and encouraged landlords and tenants to engage in transparent communication to prevent legal entanglements.
Tenant’s Predicament
Having fulfilled her obligations and maintained the property in good condition for the past 6 years, the tenant, Mrs. Owolabi (not real name) faced resistance when seeking a refund of her caution fee.
The tenant clearly remembered that the landlord and his agent explained to her that the caution fee would be returned if she did not damage anything in the house. Mrs. Owolabi further explained that when things were damaged in the house, she used her own money to repair it without asking the landlord, thinking she would get the caution fee back. The case is yet to be decided in favour of any of the parties.
The fact remains that this is common in Ikeja, where tenants may encounter difficulties reclaiming their rightfully owed funds.
Solution for tenants:
- Document Everything: Tenants should meticulously document the condition of the property upon moving in and make note of any existing damages. This comprehensive record can serve as evidence in case disputes arise during the refund process.
- Know Your Rights: Understanding the tenancy laws in Ikeja is crucial. Tenants should be aware of their rights, including the refundability of caution fees and the procedures for dispute resolution.
- Legal Assistance: In cases of disagreement, seeking legal counsel is advisable. Engaging a lawyer who specializes in tenancy disputes can expedite the resolution process and ensure that tenants receive what is rightfully theirs.
Landlords’ predicament
On the flip side, landlords in Ikeja are grappling with challenges related to rent payments and property sales. Some tenants in Ikeja have refused to pay their rent based on the fact that they understand that Ikeja tenancy law or Lagos, in general, is favourable to the tenants. Others just don’t have the money because of economic hardships in Nigeria.
The tenant-friendly legal landscape in Ikeja can pose difficulties for landlords attempting to address non-payment issues and sell their properties. Here are some solutions the lawyer gave to the landlords:
Solution for Landlords
- Screen Tenants Thoroughly: To mitigate the risk of non-payment, landlords should implement a rigorous tenant screening process. This includes conducting background checks and verifying the financial stability of potential tenants.
- Regular Communication: Establishing open lines of communication with tenants can foster a positive landlord-tenant relationship. Encourage tenants to communicate any financial difficulties early on to find amicable solutions.
- Professional Property Management: Employing the services of a professional property management company can help landlords navigate legal complexities and streamline rent collection processes.
In conclusion, while challenges persist for both landlords and tenants in Ikeja, proactive measures, legal awareness, and open communication can pave the way for smoother tenancy experiences. It is crucial for both parties to understand their rights and responsibilities to foster a harmonious landlord-tenant relationship in this thriving real estate market.
