Setback as Court gives verdict on Buhari’s ex-minister’s lawsuit against Tinubu

A suit seeking to void the nomination of Asiwaju Bola Ahmed Tinubu as the presidential candidate of the ruling All Progressives Congress (APC) has hit the rock.

This is as the Federal High Court sitting in Abuja dismissed the suit as the presiding judge Justice Justice Zainab Abubakar held that she lacked jurisdiction to entertain the suit.

The suit, marked FHC/ABJ/CS/1114/2022 with Tinubu, the APC and the Independent National Electoral Commission (INEC) as defendants, was instituted by former lawmaker and Minister of State for Education, Chukwuemeka Nwajiuba.

Delivering the judgement on Friday, December 23, Justice Abubakar said the suit was filed outside the 14 days allowed under Section 285(9) of the Constitution, thus it was statute-barred.

Ikeja Bird recalls that this is the second time the former minister would drag the APC flagbearer and 2023 election frontrunner to the court.

Nwajiuba and a group, Rights for All International (RAI), had filed a lawsuit numbered FHC/ABJ/CS/942/2022 before Justice Inyang Ekwo of the Federal High Court in Abuja.
